A Federal High Court in Abuja has refused to stop Governor Siminalayi Fubara from using government funds while the case filed by the Martin Amaewhule-led Rivers State House of Assembly is being heard and determined.
Justice Emeka Nwite decided not to grant the prayers in the ex parte motion, instead directing the plaintiffs to serve the ex parte motion on the 5th to 10th defendants in the case by alternate means and to publish the relevant documents in the Nation Newspapers.
He scheduled the next hearing for the 7th of August to address the motion on notice.
The 5th to 10th defendants are Mr Fubara, Accountant-General of Rivers; Rivers Independent Electoral Commission (RSIEC); Chief Judge of Rivers, Justice S.C. Amadi; Chairperson of RSIEC, Adolphus Enebeli and the Government of Rivers State respectively.
The first and second plaintiffs, the Rivers State House of Assembly and Martin Amaewhule filed the suit through their counsel, Joseph Daudu SAN, against the Central Bank of Nigeria, Zenith Bank Plc, Access Bank PLC, and the Accountant General of the Federation as the first to fourth defendants.
The ruling comes after the Court of Appeal, Abuja, nullified the expulsion of the Rivers House of Assembly members led by Martin Amaewhule.
Governor Fubara insists that he would stand firm and refuse to lead the state from a position of submission, regardless of political pressure.
