The family of 23-year-old Yusuf Shuaibu, allegedly killed by Nigerian Air Force (NAF) personnel Sergeant Aminu Ibrahim, has filed a fundamental human rights case against him.
Shuaibu, a cleaner at the 465 Nigerian Air Force Hospital in Kano, died on May 1 after reportedly being severely assaulted and tortured by Ibrahim at the hospital premises.
The family, represented by their lawyers A.A. Hikima and Co., is demanding N500 million in compensation.
The case, filed at the National Industrial Court, Kano division, lists Ibrahim and the Nigerian Air Force as defendants.
The motion, based on sections 33, 34, and 35 of the Nigerian Constitution and the Fundamental Human Rights Enforcement Procedure Rules, claims that the assault leading to Shuaibu’s death violated his right to life and dignity.
The plaintiff seeks several declarations from the court:
The physical assault and torture of Shuaibu by Ibrahim, causing traumatic injuries and death, violated Shuaibu’s right to life.
2. The severe assault causing bruises and lacerations violated Shuaibu’s right to dignity.
3. Forcing Shuaibu to work beyond his hours constituted illegal forced labor.
4. Preventing Shuaibu from leaving the hospital premises after working hours violated his right to freedom of movement.
The family also requests:
1. N500 million in compensation for the violation of Shuaibu’s rights.
2. N50 million in exemplary damages to deter future abuses.
3. Disciplinary action against Ibrahim by the NAF.
4. A public apology from the defendants to Shuaibu’s family.
5. Coverage of legal costs and any other orders the court deems just.
