MTN Challenges Ghana Market Regulator in Court

MTN Ghana is challenging a high court ruling it believes will limit growth and development potential.

The high court in Ghana agrees with the National Communication Authority which states that MTN Ghana has an unfair market share over other competitors.

In June 2020, the NCA classified MTN Ghana as having a significant market power. Under Ghanaian laws, such will require the regulator to take corrective actions to enable other firms compete favourable with the market leader. The classification was based on statistics gathered and collated by NCA as part of its oversight functions.

MTN Ghana sought redress in the lower court but that has been rejected. In a statement in September, MTN “maintained its position that the NCA’s decision was unfair from a procedural standpoint and would “explore all available options and next steps in this process”.

As a last option, MTN Ghana has approached Ghana’s Supreme Court to determine if it truly has an unfair advantage and undue market share over other competitors.
