The High Court of Zimbabwe in Harare has set aside Magistrate Lazini Ncube’s decision to detain in prison vice president Constantino Chiwenga’s estranged wife Marry Mubaiwa-Chiwenga for medical examination calling the decision “capricious” and “arbitrary”. Marry Mubaiwa-Chiwenga was represented by Beatrice Mtetwa and Doug Coltart.
On November 16, the Vice President’s estranged wife was remanded in custody for 10 days to undergo mental evaluation to ascertain if she is fit to stand trial.
Magistrate Lazini Ncube ordered Marry Mubaiwa (39) to be detained at Harare Remand Prison and be brought to court on November 26.
The sickly former fashion model is facing charges of attempting to kill Chiwenga when he was bedridden.
Mubaiwa’s lawyer, Beatrice Mtetwa challenged the assertion that she is fit to stand trial. She is also accused of money laundering and assaulting a house maid.
